Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and ParallelSignal GmbH ("Company", "we", "us", "our"), governing your access to and use of the DumpFlow mobile application ("App", "Service").

By downloading, installing, or using DumpFlow, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

DumpFlow is a voice-first productivity application designed for individuals with ADHD and neurodivergent minds. The Service provides:

• Voice recording functionality for brain dumps
• AI-powered transcription of voice recordings
• Intelligent task extraction and organization
• Daily planning and task management features
• Streak tracking for habit building

3. Eligibility

To use DumpFlow, you must:

• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be barred from using the Service under applicable law
• Provide accurate and complete registration information

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription and Billing

5.1 Free Trial

New users receive a 7-day free trial with full access to all features. The trial begins when you start the subscription process. You will not be charged during the trial period.

5.2 Subscription Plans

After the free trial, continued access requires a paid subscription:

• Monthly Plan: $6.99 per month
• Annual Plan: $49.99 per year (equivalent to $4.17/month)

5.3 Payment Processing

All payments are processed through Apple's App Store. By subscribing, you also agree to Apple's terms and conditions. We do not have access to your payment information.

5.4 Automatic Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your App Store account settings.

5.5 Refunds

Refund requests must be directed to Apple through the App Store. We cannot process refunds directly. Apple's refund policies apply.

6. Acceptable Use

You agree to use DumpFlow only for lawful purposes. You must NOT:

• Use the Service for any illegal activity
• Upload content that is harmful, abusive, or violates others' rights
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to access the Service without permission
• Transmit viruses, malware, or other harmful code
• Impersonate any person or entity
• Use the Service to spam or harass others

7. Your Content

7.1 Ownership

You retain all ownership rights to the content you create using DumpFlow, including voice recordings, transcriptions, and tasks ("Your Content").

7.2 License to Us

By using the Service, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the Service. This includes:

• Transcribing your voice recordings
• Extracting and organizing tasks using AI
• Storing and displaying Your Content to you

We do not use Your Content for advertising, sell it to third parties, or use it to train AI models.

7.3 Content Backup

While we take reasonable measures to protect Your Content, you are responsible for maintaining your own backups. We are not liable for any loss or corruption of Your Content.

8. Intellectual Property

The DumpFlow application, including its design, features, code, graphics, and documentation, is owned by ParallelSignal GmbH and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes, subject to these Terms.

You may not copy, modify, distribute, sell, or lease any part of the App without our written consent.

9. Third-Party Services

DumpFlow uses third-party services to provide functionality:

• Deepgram: Voice transcription
• OpenAI: Task extraction AI
• Supabase: Data storage and authentication
• RevenueCat: Subscription management

These services have their own terms of service and privacy policies. We are not responsible for their actions or policies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Accuracy or reliability of any content

We do not warrant that the Service will meet your requirements or that any errors will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ParallelSignal GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
• We are not liable for damages arising from your use or inability to use the Service

Some jurisdictions do not allow limitations on implied warranties or liability, so some of these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless ParallelSignal GmbH and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content

13. Termination

13.1 By You

You may stop using the Service at any time. To delete your account, use the account deletion feature in the App settings or contact us at [email protected].

13.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for termination include:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Requests by law enforcement

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete Your Content. Sections regarding intellectual property, disclaimers, liability, and governing law survive termination.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. For material changes, we will provide notice through the App or via email.

Your continued use of the Service after changes constitute acceptance of the modified Terms. If you disagree with changes, you must stop using the Service.

15. Governing Law and Disputes

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through:

1. Good faith negotiation between the parties
2. Mediation in Zurich, Switzerland
3. If mediation fails, binding arbitration or litigation in the courts of Zurich

16. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms. We may assign them freely.
• Force Majeure: We are not liable for delays caused by circumstances beyond our reasonable control.
